Terms of Use (EULA)

These Terms of Use ("Terms") govern your use of the Orbicly mobile application (the "App") provided by Orbicly ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the App.

2. Description of Service

Orbicly is a music streaming application that allows users to discover, listen to, and organize music content. Some features may require a paid subscription.

3. Subscriptions and Payments

• Orbicly offers auto-renewable subscription plans (Individual, Duo, Family, Student) that provide access to premium features.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Reproduce, distribute, or create derivative works from any content available through the App.
• Interfere with or disrupt the App's servers or networks.

5. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are the property of Orbicly or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6. Content and Music

Music and audio content available through the App is provided by third-party services and is subject to their respective terms and licensing agreements. Orbicly does not claim ownership of any third-party music content.

7. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's reliability, availability, or fitness for a particular purpose.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Orbicly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

10. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Orbicly operates, without regard to its conflict of law provisions.
